1. Use of Our Website

2. Products & Print-on-Demand Disclaimer
All Luxe Bandita products are made to order. This means:
- Items are produced after purchase and may have slight variations in color, placement, or design.
- We do not hold inventory for most items.
- Availability, materials, and production methods may change without notice.
We reserve the right to modify or discontinue products at any time without liability.
3. Pricing & Payment
All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to:
- Correct pricing errors
- Cancel orders due to incorrect pricing or suspected fraud
Payment must be received in full before an order is processed.
4. Order Acceptance & Cancellation
We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to:
- Suspected fraud or unauthorized transactions
- Errors in product or pricing information
- Issues with payment processing
Orders may only be modified or canceled within 12 hours of purchase, and changes are not guaranteed once production has begun.
5. Shipping Policy
By placing an order, you agree to our Shipping Policy. Key terms include:
- Orders are processed within 2–5 business days
- Delivery timeframes are estimates and not guaranteed
- Risk of loss transfers to the customer upon delivery to the carrier
- Luxe Bandita is not responsible for lost, stolen, or delayed packages once in the carrier’s possession

6. Return & Refund Policy
Due to the made-to-order nature of our products:
- We do not accept returns or exchanges for sizing issues or change of mind
- Refunds or replacements are only offered for damaged, defective, or incorrect items reported within 7 days of delivery
By purchasing from us, you agree to our Return Policy.
7. Intellectual Property & Artwork Ownership
All content on this site—including but not limited to designs, artwork, logos, graphics, illustrations, text, and images—is the exclusive property of Luxe Bandita by Kristen Schulle and is protected by copyright, trademark, and other intellectual property laws.
- All artwork is original and owned solely by Luxe Bandita by Kristen Schulle unless otherwise stated.
- Unauthorized use, reproduction, distribution, modification, or commercial exploitation of any artwork or content is strictly prohibited.
- Purchase of a product does not grant ownership or rights to reproduce the design.
- Any unauthorized use may result in legal action.
8. User Submissions
If you submit reviews, comments, or other content:
- You grant Luxe Bandita a non-exclusive, royalty-free, perpetual right to use, reproduce, and publish such content
- You agree your submissions will not violate any third-party rights or contain unlawful material
9. Third-Party Services
We may use third-party providers for payment processing, fulfillment, and shipping. Luxe Bandita is not responsible for the performance, actions, or failures of these third parties.
10. Disclaimer of Warranties
All products and services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
We do not guarantee that the website will be uninterrupted, secure, or error-free.
11. Limitation of Liability
To the fullest extent permitted by law, Luxe Bandita shall not be liable for any:
- Indirect, incidental, or consequential damages
- Loss of profits, revenue, data, or use
- Shipping delays, delivery failures, or carrier-related issues
Our total liability shall not exceed the amount paid for the product in question.
12. Indemnification
You agree to indemnify and hold harmless Luxe Bandita from any claims, damages, liabilities, or expenses arising from your violation of these Terms or misuse of our website or products.
13. Force Majeure
We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, supply chain disruptions, labor disputes, or carrier delays.
14. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to conflict of law principles.
15. Changes to Terms
We reserve the right to update or modify these Terms at any time. Changes will take effect immediately upon posting to our website. Continued use of the site constitutes acceptance of those changes.
16. DMCA Takedown Policy
Luxe Bandita respects the intellectual property rights of others and expects the same in return. If you believe that any content on our website infringes upon your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”).
To file a DMCA takedown notice, please provide the following information in writing:
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing, including its location on our website (URL)
- Your contact information, including name, address, telephone number, and email address
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner

Upon receipt of a valid DMCA notice, Luxe Bandita reserves the right to remove or disable access to the allegedly infringing material and take appropriate action, including termination of repeat infringers.
DMCA Counter-Notice Policy
If you believe that material you posted on our website was removed or disabled by mistake or misidentification, you may submit a counter-notice under the DMCA.
Your counter-notice must include:
- Your physical or electronic signature
- Identification of the material that has been removed or disabled and the location where it appeared before removal
- A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification
- Your name, address, telephone number, and email address
- A statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., the jurisdiction in which Luxe Bandita operates) and that you will accept service of process from the party who filed the original DMCA notice

17. Cease & Desist / Enforcement of Intellectual Property Rights
Luxe Bandita actively monitors and enforces its intellectual property rights.
- Any unauthorized use of Luxe Bandita’s artwork, designs, branding, or content—including reproduction, resale, distribution, or modification—constitutes infringement.
- Luxe Bandita reserves the right to issue cease and desist notices to any individual or entity engaged in unauthorized use of its intellectual property.
- Failure to comply with a cease and desist notice may result in further legal action, including but not limited to claims for damages, injunctive relief, recovery of profits, and reimbursement of legal fees to the fullest extent permitted by law.
- Luxe Bandita also reserves the right to pursue enforcement through third-party platforms (including marketplaces and social media), payment processors, and hosting providers to remove infringing content.
Enforcement actions may be taken without prior notice at Luxe Bandita’s sole discretion.
18. Statutory Damages & Legal Remedies (U.S. Copyright Law)
To the fullest extent permitted under applicable law, Luxe Bandita reserves all rights to pursue statutory damages and legal remedies for copyright infringement.
- Infringers may be subject to statutory damages of up to $150,000 per work for willful infringement under U.S. Copyright Law (17 U.S.C. § 504).
- Luxe Bandita reserves the right to seek actual damages, disgorgement of profits, injunctive relief, and recovery of attorneys’ fees and legal costs where permitted by law.
- Willful infringement includes, but is not limited to, knowingly reproducing, selling, distributing, or displaying Luxe Bandita artwork without authorization.
Nothing in these Terms limits any rights or remedies available under federal or state law.
By using this website and placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
